The crimes of defenders and litigation agents destroying evidence, fabricating evidence, and obstructing testimony are always hanging over the lawyers’ heads like a sword of Damocles. However, some lawyers across the country have been arrested innocently. There are also many incidents. The risks of representing criminal cases are getting higher and higher. Statistics show that less than 30% of criminal cases nationwide have lawyers involved, and this proportion is still declining. In July this year, at the Chengjiang County Court in Yunnan Province, a lawyer simply failed to comply with the judge’s illegal instructions. The judge actually asked the bailiff to handcuff the lawyer and hang him on the court’s basketball stand in the sun for about 40 minutes. When lawyers are in a harsh living environment and are unable to fight in accordance with the law, they may choose to collude with the judges, obey the “hidden rules” and form a corrupt alliance with the judges.
To investigate and deal with a corrupt judge, we bring out one or a group of lawyers; to investigate and deal with another corrupt judge, we bring out another or another group of lawyers. Why is there behind every corrupt judge one or a group of lawyers who are violating the law? This probably cannot be explained by the greed and quality of lawyers. How much responsibility should our judicial system bear for it?
